Fishing Waiver & Release of Liability.
Please read the waiver carefully and sign below before your charter or fishing academy session.
This Waiver and Release of Liability is made and entered into by and between the undersigned parent/guardian (the "Parent/Guardian") and Island Time Fishing LLC (the "Host").
1. Acknowledgment of Risk
The Parent/Guardian acknowledges that fishing activities, including but not limited to the use of fishing equipment, watercraft, and participation in fishing-related activities, involve inherent risks and hazards that may result in injury, illness, or death. These risks include, but are not limited to, drowning, accidents with watercraft, exposure to weather conditions, and encounters with wildlife.
2. Assumption of Risk
By signing this Waiver, the Parent/Guardian assumes all risks, both known and unknown, related to the minor child's participation in fishing activities. The Parent/Guardian acknowledges that they have informed themselves of the potential risks and voluntarily agrees to allow their minor child to participate in these activities.
3. Release and Waiver of Liability
The Parent/Guardian, on behalf of themselves and their minor child, hereby releases, waives, discharges, and covenants not to sue Island Time Fishing LLC, its owners, officers, employees, agents, and volunteers from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the minor child, whether caused by the negligence of the Host or otherwise, while participating in fishing activities or while in, on, or upon the premises where the activities are being conducted.
4. Indemnification
The Parent/Guardian agrees to indemnify and hold harmless the Host from any loss, liability, damage, or costs, including court costs and attorney's fees, that the Host may incur due to the minor child's participation in fishing activities.
5. Medical Treatment Authorization
In the event of an emergency, the Parent/Guardian authorizes the Host to seek medical treatment for the minor child and agrees to be responsible for any medical expenses incurred as a result.
6. Photo/Video Release
The Parent/Guardian grants permission to the Host to use photographs and/or video recordings of the minor child taken during the fishing activities for promotional purposes without compensation.
7. Governing Law
This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the state of Rhode Island.
8. Severability
If any provision of this Waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
